Terms & Conditions
Last updated: 2026-10-19
Welcome to Kasi Deliveries. These Terms & Conditions ("Terms") govern your use of the Kasi Deliveries platform, whether you are a customer placing an order, a shop offering food for sale, or a driver delivering orders. By using the platform in any of these capacities, you agree to these Terms.
These Terms are issued in accordance with the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), section 43, and are intended to comply with the Consumer Protection Act 68 of 2008 ("CPA") and the Protection of Personal Information Act 4 of 2013 ("POPIA").
1. Who we are
Kasi Deliveries is a trading name of KASI DELIVERIES (PTY) LTD (registration number 2026/834126/07), with its registered office at 11 Stephenson St, Arcadia, East London, Eastern Cape, 5201, and its physical address at 3029 Zibisini Street, Daveyton, 1520. You can reach us at kasideliveries00@gmail.com.
Kasi Deliveries is a technology platform that connects customers with independent local shops and independent delivery drivers. We are not the restaurant, we do not prepare food, and we are not the courier. The shop is the seller of the food; the driver is an independent service provider for delivery. Where the CPA applies, the shop is the supplier of the goods and is responsible for their quality, description, and safety.
2. Eligibility
You must be at least 18 years old to register an account and place orders. If you register on behalf of a business (a shop or a driver service), you confirm you have authority to bind that business. Drivers must hold a valid driver's licence and any other legally required permits, and must keep their documents up to date.
3. Account registration and security
You are responsible for the accuracy of the information you provide and for keeping your password confidential. You must notify us immediately if you suspect unauthorised access. You may not create accounts under false details, impersonate another person, or use the platform for any purpose other than placing, fulfilling, or delivering food orders.
4. Orders, pricing, and payment
All prices are shown in South African Rand (ZAR) and include VAT where applicable. Before you confirm an order, the checkout page displays the total amount payable, broken down into the item subtotal, the platform fee, the delivery fee, any tip, any discount, and any loyalty redemption. No hidden charges are added after you confirm.
We accept two payment methods: EFT (bank transfer) and cash on delivery. For EFT orders, the bank details and payment reference are shown on the order confirmation page. The shop verifies your payment before preparing the food. For cash orders, you pay the driver on delivery.
The price displayed at checkout is the price you agree to pay. We may adjust platform fees or delivery fee bands from time to time, but any change applies only to orders placed after the change is published.
5. Delivery
Delivery is performed by independent drivers. You will receive a delivery PIN when you place the order; give this PIN to the driver only when the order is handed to you. The driver uses the PIN to confirm delivery. Live tracking of the driver is available on the order page until delivery is complete.
Delivery times shown in the app are estimates. While we and our drivers work to deliver quickly, weather, traffic, and unforeseen events can cause delays. If delivery is significantly delayed, please use the Help page or the order chat.
6. Cancellations and refunds
Because food is a consumable product, it is excluded from the 7-day cooling-off right under section 44 of ECTA. Refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.
7. Loyalty points and referral credit
Loyalty points and referral credit are promotional and have no cash value. They cannot be transferred, sold, or redeemed for cash. We may modify or discontinue the loyalty programme at any time, but accrued points at the time of a change will be honoured for 60 days.
8. Shop owner and driver obligations
Shop owners warrant that they hold all necessary permits (including a Certificate of Acceptability where required), that food is prepared in a safe and hygienic manner, that menu items and prices are accurate, and that they comply with all applicable food-safety and consumer laws.
Drivers warrant that they hold a valid driver's licence, that their vehicle is roadworthy and insured, that they will handle food safely, and that they will behave professionally toward customers and shops.
We may suspend or terminate any shop or driver account that breaches these obligations, that receives repeated verified complaints, or that poses a risk to customers.
9. Subscriptions
Shop and driver accounts may be subject to a monthly subscription fee, the amount of which is displayed in the app and may be changed with reasonable notice. Subscriptions are billed monthly and renew automatically for the following month unless cancelled. Subscriptions are not refundable for partial months except as required by law.
10. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for the quality, safety, or description of food prepared by a shop. That responsibility rests with the shop.
- We are not liable for loss or damage caused by a driver's acts or omissions during delivery, beyond what is required by the CPA or any other law.
- We are not liable for indirect, consequential, or special losses, including loss of profit or data.
- Nothing in these Terms excludes or limits any right you have under the CPA that cannot lawfully be excluded or limited.
11. Disputes
If you have a dispute, first use the Help page or the order chat. We will work with the shop and driver to resolve the matter. If it cannot be resolved through the platform, you may refer it to the Consumer Goods and Services Ombud (CGSO) or to a competent court.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be published on this page with a new "Last updated" date, and where the law requires, we will notify you by email. Continued use of the platform after a change constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any dispute is subject to the exclusive jurisdiction of the South African courts.
